Pintagrow Terms and Conditions of Use and Purchase
1. Service identification
Pintagrow is a digital platform focused on early childhood development through personalized books, printable worksheets, educational activities, and guidance-oriented reports based on observation of the child’s graphic process. Pintagrow’s commercial representative is PINTAGROW Spa, tax ID 11111111-1, with business address at DOMICILIO COMERCIAL and contact email soporte@pintagrow.com. If these details are not yet defined, they may be completed before the final commercial activation of the service.
2. Acceptance of the terms
By accessing the website, creating an account, purchasing, downloading a book, uploading a worksheet, or using any Pintagrow service, the user declares that they have read, understood, and accepted these Terms and Conditions and the Privacy Policy. Before making a payment, the user must tick a mandatory checkbox. Acceptance will be recorded electronically with date, time, language, version, IP address, browser, and other technical audit data.
3. Users and adult authorization
Contractual use and purchases are intended for adults or responsible adult representatives. When the service involves data, name, age, images, worksheets, drawings, or information relating to a child or adolescent, the user declares that they are the parent, legal guardian, responsible adult, or that they have sufficient authorization to provide such information and use the service.
4. Nature of the digital product
Pintagrow provides digital products and services, including personalized books, printable worksheets, downloadable educational materials, guidance-oriented reports, and support tools for families or authorized professionals. Delivery may occur by direct download, email, user portal, or another digital method disclosed during the purchase process.
5. Content personalization
The user is responsible for providing accurate, complete, and up-to-date information to generate personalized products. Pintagrow will not be responsible for errors in the final product when they arise from incorrect, incomplete, or improperly entered user data, including name, language, age, email address, selected book, images, or other background information.
6. Permitted use and prohibitions
The user may use Pintagrow books, worksheets, reports, and materials for personal, family, educational, or non-commercial child-support purposes. It is prohibited to resell, sublicense, commercially distribute, massively publish, copy to create commercial derivative products, remove legal notices, or use Pintagrow’s brand, methodology, texts, designs, illustrations, or structure as one’s own without prior written authorization.
7. Educational purpose and non-diagnostic nature
Pintagrow is an educational, creative, and guidance-oriented tool. Its reports, interpretations, or recommendations do not constitute medical, psychological, psychiatric, psychoeducational, speech-language, therapeutic, or clinical diagnosis. Pintagrow does not replace the assessment, diagnosis, treatment, or follow-up of qualified health, education, or child-development professionals.
8. Technology and artificial intelligence
Pintagrow may use computer systems, algorithms, artificial intelligence models, or other technical tools to process images, analyze worksheets, organize information, personalize content, and generate reports. The user understands that these results may contain errors, inaccuracies, or limitations and must be treated as guidance support. If inconsistencies are detected, Pintagrow may pause the flow for manual review.
9. Upload of images, worksheets, and comments
By uploading images, worksheets, drawings, photographs, comments, or background information, the user declares that they have sufficient authorization and do not infringe third-party rights. Pintagrow may reject, delete, block, or leave unprocessed any content that is offensive, illegal, discriminatory, violent, sexual, defamatory, malicious, fraudulent, or contrary to the educational purpose of the service.
10. Personal data and privacy
Personal data processing is governed by Pintagrow’s Privacy Policy, which forms an integral part of these Terms. Pintagrow may process adult user data and data associated with the child only to provide the service, process payments, generate books, process worksheets, issue reports, provide support, maintain security, auditability, and legal compliance.
11. Authorized professionals
Where a professional referral module exists, access by occupational therapists, speech-language therapists, psychologists, psychoeducational specialists, educators, or other professionals to data, worksheets, or reports will require prior authorization from the responsible adult through a specific consent flow. The adult may accept, reject, or revoke permissions according to the service conditions.
12. Price, currency, taxes, and payment
The price, currency, applicable taxes, and payment method will be disclosed before purchase. Pintagrow may operate in CLP, USD, or other enabled currencies depending on country, website configuration, and available payment gateway. Payments may be processed through Transbank, PayPal, or other providers. A purchase is confirmed only when payment is approved and the order is recorded.
13. Delivery of the digital product
Once payment is confirmed, Pintagrow will generate or enable access to the purchased digital product. Delivery may occur by direct download, email, user portal, or later automatic generation when the product requires processing. Delivery times may vary depending on system load, internal validations, or necessary technical processes.
14. Withdrawal right, changes, and refunds
The user may exercise the applicable statutory withdrawal right only if the service has not begun and personalized digital content has not been used. The service will be deemed to have begun if the user downloads, opens, or accesses the personalized book; if Pintagrow generates and sends it; if the user uploads a worksheet, image, or comment; if processing begins; or if a report is generated or made available. In case of a technical failure attributable to Pintagrow, the user may request review, regeneration, reasonable correction, or an equivalent solution.
15. Accounts, security, and availability
The user must protect their credentials, private links, tokens, or download codes. Pintagrow will seek to keep the service available and secure, but interruptions may occur due to maintenance, updates, connectivity, external providers, payment gateways, email services, servers, or force majeure. Pintagrow may suspend access if it detects suspicious activity, abusive use, or a security risk.
16. Intellectual property and user content
The Pintagrow brand, methodology, design, texts, worksheets, books, illustrations, reports, software, code, flows, databases, and analysis models belong to Pintagrow or their respective owners. Purchase grants a limited, personal, non-exclusive, non-transferable, non-commercial license. The user retains any rights they may hold over uploaded images or content and authorizes their use only to the extent necessary to provide the contracted service.
17. Limitation of liability
Pintagrow will not be responsible for unmet subjective expectations, inappropriate use of materials, third-party interpretations, medical, therapeutic, psychological, school, or family decisions made solely on the basis of a report, errors arising from incorrect user information, or failures of external services. Pintagrow reports must not be used as the sole basis to diagnose, treat, refer, medicate, intervene, or clinically assess a child.
18. Changes, applicable law, and contact
Pintagrow may modify these Terms for legal, technical, commercial, or operational reasons. The current version will be available on the website, and Pintagrow may retain the version accepted by each user. These Terms are governed by the laws of the Republic of Chile.
